LEGAL TERMS
• BEARER PAPER: A negotiable instrument which can be transfered by delivery. It
does not require endorsment.
• BENCH: Judge or judges composing a court.
• BENCH WARRANT: A document issued by a criminal court in which a criminal action
is pending, directing a police officer to take into custody a
defendant in the action who has previuosly been arraigned and
to bring him/her before the court. The function of a bench
warrant is to achieve the court apperance of a defendant in a
pending criminal action for some purpose other than his/her
initial arraignment in the action.
• BENCH TRIAL: Trial before a judge.
• BENEFICIARY: The person named in a will or trust to receive property.
• BEQUEATH: Yhe legal word which refers to the giving of personal property by will.
• BEYOND A REASONABLE DOUBT: The standart of proof required to convict a
criminal defendant.
• BIFURCATED TRIAL: To try issues of case separately in the hope that by resolving
one issue, other issues may settle short of trial.
• BILL OF SALE: A written statement by which one person transfers to another his
rights to personal property.
